1. What we provide
Bashmob, Joymob and Confetto (together, "the Service") are event-experience products operated by RoseTech LLC ("we," "us"). When you purchase an event, we provide a private event page your guests join by QR code, a live big-screen display, interactive games, a shared photo/video album, and a digital guestbook, for the duration and features of the plan you purchase.
2. Purchases, pricing and refunds
- Pricing is per event, shown before checkout. Payments are processed by Stripe; we never see or store your card number.
- Every event starts in test mode so you can try everything before your guests use it.
- Refunds: if the Service failed to work for your event, or you cancel before your event goes live, reply to any of our emails and we'll refund you in full. We'd rather you be happy than keep your money.
- Sales tax may be added at checkout where required by law.
3. Your event, your responsibilities
- You must be 18 or older to purchase and host an event. By purchasing, you confirm that you are.
- You're the host: you control the moderation settings and are responsible for making sure your guests know that photos, videos and messages they post are visible to other guests and on the big screen โ and for obtaining any permission needed to photograph guests, including permission from a parent or guardian before any photo of a child is shared.
- Don't use the Service for anything unlawful, hateful, harassing, or harmful; don't upload content you don't have the right to share, that infringes anyone's rights, or that depicts a minor in a sexual manner. We may remove content or suspend events that violate this, with a refund if the violation wasn't yours.
4. You protect us for what happens at your event (indemnification)
Because you run your event and your guests, you agree to defend, indemnify, and hold harmless RoseTech LLC and its owners from any claims, damages, or costs (including reasonable legal fees) arising out of your event, the content you or your guests upload, your use of the Service, or your failure to obtain the permissions described above. This section survives after your event ends.
5. Copyright & takedowns (DMCA)
If you believe content on the Service infringes your copyright, email our designated agent at james@rosetechllc.com (subject: "DMCA") with: the work you own, the specific content and event, your contact details, and a statement, under penalty of perjury, that you're authorized to act and believe the use is unauthorized. We remove infringing content promptly and may end the events of repeat infringers.
6. Guest content and the album
- Content your guests create belongs to them; by posting, each guest grants you (the host) and RoseTech LLC a non-exclusive license to store, display, and deliver that content for the purpose of running your event and providing your album. We don't use guest content to advertise our Service without separate permission.
- All event media is automatically and permanently deleted when your plan's retention period ends (7โ365 days depending on plan โ the exact date is in your welcome email and dashboard). Download your album before then. We have no obligation to monitor content, but we may remove any content at our discretion.
7. Warranty disclaimer & limit of liability
The service is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, RoseTech LLC disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Events depend on venue Wi-Fi, guests' devices, and third-party providers we don't control, and we do not warrant the service will be uninterrupted or error-free.
To the fullest extent permitted by law, RoseTech LLC will not be liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim is limited to the amount you paid us for the event in question. Nothing here limits liability that cannot lawfully be limited (such as for fraud, willful misconduct, or personal injury).
8. General terms
- Governing law & venue. These terms are governed by the laws of the State of Ohio, USA, and any dispute will be brought exclusively in the state or federal courts located in Ohio.
- Force majeure. We aren't liable for failures caused by events beyond our reasonable control (outages, network or venue failures, provider disruptions, natural events).
- Severability. If any part of these terms is unenforceable, the rest stays in effect.
- Entire agreement. These terms and our Privacy Policy are the whole agreement between you and us about the Service.
- Assignment. You may not transfer your rights under these terms; we may assign them (for example, if the company is sold).
9. Changes and contact
We may update these terms; material changes will be posted here with a new date, and we'll email hosts with active events. Continued use after a change means you accept it. Questions, refunds, or anything else: reply to any email from us, or write to james@rosetechllc.com. The Service is provided by RoseTech LLC, an Ohio limited liability company.
